Terms of Service

These Terms of Service ("Terms") govern your access to and use of Face Yoga ("Face Yoga," "the App," "we," "our," or "us"), operated by MB Janus Digital.
By accessing or using Face Yoga, you agree to these Terms. If you do not agree, please do not use the App.
1. Description of the App
Face Yoga is a face yoga and wellness app that operates within OpenAI's ChatGPT platform. It allows users to receive face yoga guidance, exercise recommendations, progress-related features, and related wellness content based on information they provide.
The App is intended for general wellness, informational, and self-care purposes only. It does not provide medical care, diagnosis, or treatment.
2. Scope of These Terms
These Terms apply to your use of Face Yoga and related websites or pages we operate for the App, including tryfaceyoga.com.
Because the App runs inside ChatGPT, your use of ChatGPT is also subject to OpenAI's terms, policies, and platform rules.
3. Eligibility
You must be legally permitted to use ChatGPT and any other services required to use the App.
By using Face Yoga, you represent that you meet any minimum age or eligibility requirements that apply to ChatGPT and the services you use with the App.
4. Acceptable Use
You agree to use the App only for lawful purposes and in a way that does not interfere with the operation of the App or other users.
You must not:
use the App for unlawful, fraudulent, abusive, or harmful purposes;
attempt to gain unauthorized access to the App or related systems;
interfere with or disrupt the App's functionality;
submit content or information you do not have the right to use; or
use the App in a way that violates OpenAI's policies or applicable law.
We may suspend or restrict access to the App if we reasonably believe these Terms are being violated or the App is being misused.
5. Health and Wellness Disclaimer
Face Yoga provides exercise suggestions, wellness-related content, progress features, and other guidance for general informational and wellness purposes only.
The App is not a medical device and does not provide medical advice, diagnosis, or treatment. You should not rely on the App as a substitute for professional medical, dermatological, cosmetic, or other healthcare advice. If you have a medical condition, skin condition, facial injury, pain, swelling, recent procedure, or other health-related concern, you should consult a qualified professional before using the App or performing exercises suggested by it.
6. Accuracy of Results
Guidance, progress-related outputs, and other content generated by the App depend on the information you provide and automated interpretation systems. Outputs may be approximate, generalized, incomplete, or inaccurate.
The App does not guarantee that recommendations, progress-related insights, or other outputs will be complete, accurate, or error-free, and results may vary from person to person.
7. Your Content
You may submit content to the App, including photos, selfies, questionnaire answers, progress information, preferences, and other information you choose to provide ("Your Content").
You retain your rights in Your Content. You grant us a non-exclusive license to use, host, store, process, and display Your Content only as needed to operate and provide the App.
You are responsible for ensuring that you have the right to submit Your Content.
8. Intellectual Property
The App, including its branding, software, design, and related materials, is owned by MB Janus Digital or its licensors and is protected by applicable intellectual property laws.
You may use the App for your personal, lawful use. You may not copy, reproduce, sell, or commercially exploit the App or its content except as permitted by law or with our written permission.
9. Third-Party Services
Face Yoga operates within OpenAI's ChatGPT environment and may rely on third-party services for hosting, storage, analytics, infrastructure, and model processing.
We are not responsible for third-party services we do not control, including ChatGPT itself or third-party providers. Your use of those services is governed by their own terms and policies.
10. Privacy
Your use of the App is also subject to our Privacy Policy, which explains how we process information in connection with the App.
11. Availability and Changes to the App
We may update, modify, or discontinue parts of the App from time to time.
We do not guarantee that the App will always be available, uninterrupted, or error-free.
12. Termination
You may stop using the App at any time.
We may suspend or terminate access to the App if we reasonably believe you have violated these Terms, misused the App, or created risk for the App or other users.
13. Disclaimer
To the maximum extent permitted by law, the App is provided on an "as is" and "as available" basis.
We make no warranties, express or implied, about the App, including warranties of availability, accuracy, reliability, or fitness for a particular purpose.
14. Limitation of Liability
To the maximum extent permitted by law, MB Janus Digital will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of, or inability to use, the App.
Nothing in these Terms excludes or limits liability where such exclusion or limitation is not permitted by applicable law.
15. Changes to These Terms
We may update these Terms from time to time. If we do, we will post the updated version and revise the effective date at the top of the page.
By continuing to use the App after updated Terms become effective, you agree to the revised Terms.
16. Governing Law
These Terms are governed by applicable law, without regard to conflict of law principles.
17. Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions will remain in full force and effect.
